Are Board’s Now Punitive Arms of Government With a License to Intimidate, Harass and Enforce?
Licensing board’s are many times made up of a handful of professionals, some unlicensed lay people of various backgrounds. The purpose of the boards is suppose to create a group of overseers who can objectively assist in the self governance of a profession. A self governing board is most commonly found in professions such a doctors, lawyers or engineers for example.
Other types of boards may be governed by a state agency under an administrative regulatory scheme such as plumbers, insurance, hairstylist and electricians. Both are suppose to be in place for protection of the public welfare so as to maintain a professional standard so the public has the best service available. However, we are seeing a corruption of the boards in a deeply concerning way.
Most recently its been seen in what some could call Lawfare. Lawfare? yes, like warfare, but instead of canons and shooting it’s the misuse and abuse of the legal system to cause damages to a professionals reputation or livelihood. Covid saw the rise of doctors being called before boards. January 6ht sparked a sharp increase in lawfare in the legal industry.
Is it time for professionals – as self governing bodies – to reevaluate the long term usefulness of such boards? Or at least heavily modify them so the improper and unethical practices of law fare can end once and fore all.
